5. Analogue to Digital Tape Transfer Services
- Nature of Media: You acknowledge that magnetic tape and film are unstable media that degrade over time. We cannot guarantee the final quality of the digital transfer if the source material is physically damaged or chemically degraded.
- Limitation of Liability (The “Safe Handling” Clause): We treat all media with extreme care. However, in the event of loss or damage to your physical media while in our possession or during the transfer process, our liability is strictly limited to the replacement cost of the equivalent blank media. We do not accept liability for the sentimental, historical, or “intrinsic” value of the content recorded on the media.
- Customer Risk: Shipping media to us is at the Customer’s risk. We strongly recommend using a tracked, insured courier service.
- Waiver of Cancellation Rights: By submitting media for transfer, you expressly request that the service begins immediately. You acknowledge that your 14-day right to cancel is waived once the technical process of digitisation has commenced.
6. Content Standards and Copyright
- You represent and warrant that you own or have the necessary permissions for all materials (images, video, audio) you provide to us for web design or transfer services.
- We reserve the right to refuse any service that involves material we deem illegal, offensive, or in clear violation of third-party copyrights.
7. Limitation of Liability and Indemnification
- To the maximum extent permitted by law, MaadWeb shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or the inability to use the Service.
